Copyright guide: protecting your original work online

Intellectual Property Guide

The same online listing can raise separate questions about a brand name, a photograph and who is selling the product.

Identify the concern

A trademark can identify the source of goods or services. Copyright can protect original photography, artwork or writing. Record which element creates the concern and which party owns the relevant right.

Match the evidence to the right

For a mark, identify the sign, relevant goods or services and territory. For a photograph, identify the original image and the rights chain. A seller’s identity or description may require separate evidence under a platform impersonation policy.

Check existing relationships

Review reseller, distribution and creative licenses. Note the authorized seller, channel, geography and use of promotional materials. Escalate ambiguous contract terms for interpretation before choosing a reporting route.
