Case Notes

Public decision review · Oki Data Americas, Inc. v. ASD, Inc., WIPO Case D2001-0903.

The question before the panel

An authorized repair dealer used okidataparts.com to sell parts and service equipment. The trademark licensee sought transfer of the domain under the Uniform Domain Name Dispute Resolution Policy.

What the evidence showed

The panel considered the dealer’s actual offering, the goods promoted, its disclosure of its relationship with Oki Data and its domain registrations. It found a legitimate interest on these facts and denied the complaint.

A practical question for brand teams

When a domain incorporates a mark, examine the commercial relationship and how the site presents itself. Preserve the relevant agreements and page captures before choosing an enforcement route. This independent case note draws on the published panel decision.
